1. Acceptance of Terms

Welcome to ScrnShots. By using ScrnShots, you agree to these Terms of Service, and further agree to comply with the Community Guidelines.

These Terms of Service apply to all users of the ScrnShots website (the "Site"), including users who are also contributors ("Submitters") of content, information, and other materials on, or made available through, the Site.

By using and/or visiting the site and/or linking to any file residing on any other site that is accessed via the site, you give your assent to these terms of service.

ScrnShots reserves the right to update and change, from time to time, these Terms of Service and all documents incorporated by reference. You can always find the most recent version of this Terms of Service here: www.scrnshots.com/terms_of_service

2. Description of Service

ScrnShots provides subscribers with screenshot uploads, screenshot storage, bandwidth, browsing and sharing.

3. ScrnShots ID Requirement

In consideration of your use of ScrnShots, you agree to: (a) provide true, accurate, current and complete information about yourself and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or ScrnShots has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ScrnShots has the right to suspend or terminate your account and delete any information or content therein without liability to ScrnShots.

4. ScrnShots' Reservation of Rights

ScrnShots expressly reserves the right to immediately modify, delete content from, suspend or terminate your account and refuse current or future use of any ScrnShots service, if ScrnShots, in its sole discretion believes you have: (i) violated or tried to violate the rights of others; or (ii) acted inconsistently with the spirit of the Community Guidelines or these Terms of Service. In such event, your ScrnShots account may be suspended or cancelled immediately in our discretion, all the information and content contained within it deleted permanently. ScrnShots accepts no liability for information or content that is deleted.

6. Indemnity

You agree to indemnify and hold harmless ScrnShots, and its subsidiaries, affiliates, officers, agents, or other partners, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of and access to ScrnShots, your violation of these Terms of Service or the Community Guidelines, your violation of any rights of another person or entity, or your violation of any applicable laws or regulations.

8. Age Requirements For Use Of ScrnShots

ScrnShots is available for individuals aged 13 years or older. If you are 13 or older but under the age of 18, you should review these Terms of Service with your parent or guardian to make sure that you and your parent or guardian understand and agree to these Terms of Service.

9. Submissions

You understand that when submitting a screenshot, you must include the source URL, and give credit to the owner in the description when available.

You hereby represent and warrant that you will not:

  • publish falsehoods or misrepresentations that could damage ScrnShots or any third party
  • submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, makes others uncomfortable or is otherwise inappropriate
  • post advertisements or solicitations of business
  • impersonate another person.
  • publish anything that includes sexually explicit images or other content which is offensive or harmful to minors
  • publish anything unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful material, including but not limited to material based on a person's race, national origin, ethnicity, religion, gender, sexual orientation, disablement or other such affiliation
  • infringe on the intellectual property rights or other rights of third parties, including trademark, copyright, trade secret, patent, publicity right, or privacy right

You understand that when using ScrnShots, you will be exposed to Submissions from a variety of sources, and that ScrnShots is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Submissions. You further understand and acknowledge that you may be exposed to Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against ScrnShots with respect thereto, and agree to indemnify and hold ScrnShots, its officers, directors, agents, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the Site.

Submitters understand and agree that third-party advertising, in any commercially reasonable format, may be made available to users of ScrnShots, including in connection with uploaded Submissions. Submitters expressly agree that they shall not be entitled to any sharing or other compensation whatsoever for any revenue generated by (or received by ScrnShots for) the display of any such advertisements.

By submitting the Submissions to ScrnShots, you hereby grant ScrnShots license to use, reproduce, distribute, prepare derivative works of, display, and perform the Submissions in connection with the Site and ScrnShots' (and its successor's) business, including promoting and redistributing part or all of the Site (and derivative works thereof). ScrnShots does not endorse any submission or any opinion, recommendation, or advice expressed therein, and ScrnShots expressly disclaims any and all liability in connection with submissions.

10. Objectionable Material

You understand that by using ScrnShots, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit subject matter. Nevertheless, you agree to use ScrnShots at your sole risk and that ScrnShots shall not have any liability to you for content that may be found to be offensive, indecent, or objectionable.

ScrnShots reserves the right to remove Submissions without prior notice. ScrnShots will also terminate a User's access to its Site, if they are determined to be a repeat violator. A repeat violator is a User who has been notified of violating these Terms of Service, or the Community Guidelines more than once and/or has had a Submission removed from the site more than once.

ScrnShots also reserves the right to decide whether any Submission is appropriate and complies with these Terms of Service for violations such as, but not limited to, pornography, obscene or defamatory material. ScrnShots may remove such Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

11. Location of Lawsuit

Both you and ScrnShots agree to submit to the personal and exclusive jurisdiction of the courts located within the province of British Columbia.

12. ScrnShots API

Customers may access their ScnShots account data via an API (Application Program Interface). Any use of the API, including use of the API through a third-party product that accesses ScrnShots, is bound by the terms of this agreement plus the following specific terms:

  1. You expressly understand and agree that ScrnShots shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if ScrnShots has been advised of the possibility of such damages), resulting from your use of the API or third-party products that access data via the API.
  2. Abuse or excessively frequent requests to ScrnShots via the API may result in the temporary or permanent suspension of your account's access to the API. ScrnShots, in its sole discretion, will determine abuse or excessive usage of the API. ScrnShots will make a reasonable attempt via email to warn the account owner prior to suspension.
  3. Scrnshots reserves the right at any time to modify or discontinue, temporarily or permanently, your access to the API (or any part thereof) with or without notice.
